I-MKTG Unlimited, LLC Policies/Terms of Service
These Terms of Service apply to all clients of I-MKTG Unlimited, LLC. 
Privacy Policy

We hate spam as much as you do. We will never share your information with third parties unless required to do so by law or requested by you. The information we collect from you will be used to maintain your services with us and to represent the quality of our work to others, such as in our online portfolio.

Ownership of Website Design

Upon completion of a custom website design and payment of web design and development fees, the client is the owner of the commissioned website. The client may continue to use the commissioned website to promote the client’s company or organization regardless of whether he/she chooses to continue further services with I-MKTG Unlimited, LLC. The client does not have the right to resell the design or development to other companies. The client does not have permission to reuse pieces of our work in a redesigned website that gives another company design credit.

Ownership of the Website Domain

Website domain names are leased from domain name registration companies. When I-MKTG Unlimited, LLC registers a domain name for a client, that registration will be made in the client’s name. Upon payment of any outstanding fees, the client has the right to use that domain name regardless of whether he/she chooses to continue further services with I-MKTG Unlimited, LLC.

I-MKTG Unlimited, LLC will monitor renewal dates of client domain names and handle all domain name renewals for the client. Domain name renewal will take place on the first Monday of each month for all domain names coming up for renewal during the current month. Domain names will automatically be renewed for 3 years at a price of $85 per domain name, and will be charged to the Client’s card on file. If Client wishes not to renew their domain name, they must contact I-MKTG Unlimited, LLC no later than the 15th day of the month prior to domain expiration. If the card on file declines, I-MKTG Unlimited, LLC will attempt contact with the client once more via phone call.  Domain name renewal fees are the responsibility of the client.

I-MKTG Unlimited, LLC cannot be responsible for expired domain names.

Ownership and Copyright

All text and photos used as content in a commissioned website must be provided by the client (unless the client has hired I-MKTG Unlimited, LLC for content development). The client must have ownership or written permission to use all content he/she provides for use. It is up to each client to ensure his/her design and/or content does not infringe on any trademark, service mark, or copyright. I-MKTG Unlimited, LLC cannot be responsible for intellectual property infringements on behalf of clients. Additionally, I-MKTG Unlimited, LLC cannot be responsible for submitted content. Clients should not mail irreplaceable photos or documents or send content that must be returned. 

Project Initiation and Project Queue

The initiation of a web design/development project requires a signed or electronically submitted signup form and payment of the initial web design/development fees. At this time, clients will be placed in the development queue in order of date and time the required documents were received. Development on a site begins once the project has been reached in the queue.

Project Timeliness

I-MKTG Unlimited, LLC prides itself in timely service. We believe that your website is an important part of your business, and as such, will make every effort to provide your completed website within 30 days of development beginning. However, Client acknowledges that they have shared responsibility in the timeliness of project completion.

Project Requirements for Clients

Projects can be hindered if the client does not provide feedback or required elements in a timely manner, such as feedback on a design, requested sitemaps, text to be used as content on the web pages, photos for
either the design or for the content, the client’s logo, appropriate account login information, etc. For that reason, if I-MKTG Unlimited, LLC is waiting for content or other pieces of information, the client will be notified. If the client fails to handle the requests within ten business days, then I-MKTG Unlimited, LLC will take any or all of the following steps to keep the project moving forward in a timely manner:

  • FEEDBACK – If the client fails to give feedback on the design within ten business days of communication by designer, by default, the design is approved.
  • SITEMAPS OR PAGE NAMES – If the client fails to provide the requested list of web pages within ten business days, by default, I-MKTG Unlimited, LLC will assign page names.
  • CLIENT LOGO – If the client fails to provide a copy of an existing logo within ten business days, a substitute logo or company name graphic may be used.
  • PHOTO TO USE IN DESIGN – If the client has requested the design include a particular photo, and the client fails to provide the required photo within ten business days, a substitute photo may be used.
  • CONTENT – Unless I-MKTG Unlimited, LLC has been hired for content development, the client is responsible for providing content for all web pages. Content submission is required no later than 30 days after design is complete, however, the sooner content is submitted, the more successful your project is likely to be. If content, in full, has not been submitted prior to 30 days post design completion notification, I-MKTG Unlimited, LLC reserves the right to begin charging appropriate hosting and maintenance charges.
  • OTHER ELEMENTS OR ADMINISTRATIVE DUTIES – There may be other elements required such as passwords for existing domain names, etc. Regardless of what element may be required, if the client cannot or will not provide the required element or information within ten business days, I-MKTG Unlimited, LLC reserves the right to make substitutions, leave elements out, or take other actions in order to complete the project.
How Content May Be Submitted

All content must be submitted electronically via email to the assigned designer. Text must be selectable as actual text rather than as flattened images. Both text and photos/graphics must be clearly labeled with the name of the page on which they will be displayed. Content may not be submitted via fax or paper copies. Exceptions to this policy must be approved in advance and may incur a surcharge.  

Modifications and Redesigns

Modification and redesign requests require written requests to be made by the client, to be sent to developers@i-mktg.com.

Modification requests will be handled as quickly as possible, usually within a 48-hour time frame from the written request being received.

Redesign requests will enter the design queue in the same manner defined for new client sites.

I-MKTG Unlimited, LLC is proud to provide website modifications and minor edits to clients on an ongoing basis as part of our modification package. “Modification” is defined as any minor change to a website’s content (i.e.: image changes, additions, or eliminations, written copy content changes, addition of upcoming events, testimonials, etc.). “Redesign” is defined as any major content overhaul, page additions, additional programming needs, or major site layout changes. Redesigns are not included in I-MKTG Unlimited, LLC’s modification package and will incur additional charges, as needed. I-MKTG Unlimited, LLC reserves the right to determine whether requested changes are considered modification or redesign on a case by case basis.

Technical Support

Clients whose websites or emails are hosted by I-MKTG Unlimited, LLC have access to emergency technical support 24 hours a day. In the event of a website hosting outage, or the inability to send and/or receive emails, clients should leave a voicemail message for the Technical Support phone extension, and a technician will be paged. The phone number is listed on the Contact Us page of our website and the phone list provided in your Client Welcome Packet. Please note, technical support cannot be provided for clients’ individual computer issues or for third party products or services. For clients who use the email services that come with our hosting accounts, the email account password and settings will be provided, but it is up to the individual client to set up his/her email in an email software program or on his/her smart phone, unless previously discussed and agreed to by both parties, expressed in writing. If a client is unable to set up his/her email, the client should contract with a computer service company for assistance.

After Hours Service

After hours service will be provided free of charge for emergencies only. “Emergencies” are defined as a website hosting outage, or the inability to send and/or receive emails. For emergency support, please follow phone protocol found in your Client Welcome Packet. All non-emergency after hours calls will be returned as soon as possible on the next business day. After hours calls that are falsely classified by the client as an emergency, and result in after hours service, are subject to an after-hours service charge of $125/hour.

Payment Policies

I-MKTG Unlimited, LLC requires a credit card on file for all clients. The credit card information provided will be used to charge initial payments, monthly service charges, domain name renewals, and any other charges associated with a client’s account, unless other arrangements have been approved. If a client needs to edit filed credit card information, a written request should be sent to billing@i-mktg.com no later than 15 days prior to the closest upcoming payment processing date.

  • INITIAL PAYMENT – Initial payments are due in full at the time of signed contract submission. Initial payments may be made by credit card or check, with credit card payment being used by default if a check is not included with signed contract.
  • GOING LIVE – Once the client’s site has gone live, monthly hosting and maintenance charges will begin automatically. Monthly fees include any applicable taxes and will be charged on the 15th of the month for the following month. This fee will be charged until the client notifies I-MKTG Unlimited, LLC to cease charges. Requests must be made in writing and submitted to billing@i-mktg.com 15 days prior to requested date.
  • MONTHLY AND LATE CHARGES – If monthly credit card charge rejects, I-MKTG Unlimited, LLC will contact client within 5 business days. Client will receive a phone call, with voicemail if necessary, and an email notifying them of declined credit charge. Client will then be responsible for contacting I-MKTG Unlimited, LLC to resolve payment issues. I-MKTG Unlimited, LLC reserves the right to charge a late payment charge of $50 to any client who fails to contact I-MKTG Unlimited, LLC within 5 business days of initial declined payment notification; accruing an additional $50 for each subsequent week of non-communication/non-payment. If client account falls behind by 2 months, I-MKTG Unlimited, LLC reserves the right to close down the website and e-mails as well as post notice of such on website. 
Billing Errors

If a billing error is noticed, the client should immediately contact I-MKTG Unlimited, LLC. Refunds of overpayments will be made for up to a maximum of three months, so clients are urged to check billing statements regularly. Refunds of more than three months will not be processed. Additionally, I-MKTG Unlimited, LLC reserves the right to bill clients for accidental undercharges for a maximum of up to three months.

Search Engine Guarantee

Most every client would like his/her website to rank high in search engine results for selected keywords, yet search engine results are determined by a multitude of constantly changing factors, third party search engines, and the amount and quality of competition on the world wide web. I-MKTG Unlimited, LLC guarantees certain search engine‐friendly techniques will be used in the creating of each custom website, such as keywords in the title bar, the meta tags in the hidden coding behind the scenes, and alternate text behind some images. If the keyword placement in these three areas is not to the client’s liking, I-MKTG Unlimited, LLC will change these three items to the client’s choices one time for free. Subsequent or additional changes will be billed at the standard hourly rate. Additional search engine optimization (SEO) services are available for additional fees. I-MKTG Unlimited, LLC cannot be held responsible for search engine results.

Search Engine Optimization, Social Media Management, and Marketing Plans

Our Marketing Plans offer a variety of services, including search engine optimization and social media (Facebook, Twitter, etc.) management. These plans require a three‐month minimum since it takes time to ramp up the effectiveness of these campaigns. After three months, the Marketing Plans convert to month‐to‐month plans, which may be canceled at any time with a 15‐day written notification. Services provided in the marketing plans will be specified in a written agreement since plans may be tailored to meet each client’s needs. No service or standard of service is implied unless in writing in the agreement, thus, clients must be sure to specify any specific request (such as a particular number of followers or a particular social networking tool used, etc.) in writing. 

Quality Guarantee

We take pride in offering high quality services and professional customer service. While we make every effort to ensure every aspect of our service is to the client’s liking, we cannot control every variable. It is up to each client to regularly test the functionality of his/her website, email, and any other product or service to ensure everything works as desired. If any problem is discovered or error has been made, please report the problem to us immediately so we may take appropriate action. We cannot be responsible for perceived loss of revenue under any circumstances. Changes resulting from a client’s error and/or problems related to third party vendors or technology, such as hosting servers or browser software may result in additional charges. 

Indemnification

Client agrees to indemnify, hold harmless, and defend I-MKTG Unlimited, LLC from all damages, including expenses and costs of any kind whatsoever, including attorneys’ fees, for which I-MKTG Unlimited, LLC may become liable by reason of the I-MKTG Unlimited LLC’s publication of the Customers advertisements on Google or anywhere else. 

Warranty

Customer warrants to I-MKTG Unlimited, LLC that Customer has the right and approval to use any and all logos, trademarks, addresses or any other material contained on the Customers’ website or provided to I-MKTG Unlimited, LLC for any purpose. Customer also warrants that I-MKTG Unlimited, LLC can use any material contained on Customers website in the ads that I-MKTG Unlimited, LLC creates for the Customer.

Termination of Services

If the client changes his/her mind about doing work with I-MKTG Unlimited, LLC during the course of the initial web design or development phase, the client will be responsible for the amount of work already completed. Depending on the amount of work completed at the time of cancellation, this may mean receiving a full refund, a partial refund, no refund, or owing additional fees.

In order to protect clients from unintentional service interruption, clients wishing to terminate any services must request the service termination in writing. 

Refusal of Service

I-MKTG Unlimited, LLC does not accept projects that promote hate, intolerance, pornography, animal exploitation, or any other unethical practice. I-MKTG Unlimited, LLC reserves the right to decline to do business with any client for any reason.

Changes to Terms of Service

I-MKTG Unlimited, LLC reserves the right to change these terms of service at any time for any reason.
